Affiliate Terms of Use

As an authorized affiliate (Affiliate) of Fappeando, you agree to abide by the terms and conditions contained in this Agreement (Agreement). Please read the entire Agreement carefully before registering and promoting Fappeando as an Affiliate.

Your participation in the Program is solely to legally advertise our website to receive a commission on products purchased by individuals referred to Fappeando in your own website, social media, mails and other means.

By signing up for the Fappeando Affiliate Program (Program), you indicate your acceptance of this Agreement and its terms and conditions.

Account Registration & Terms

We reserve the right to approve or reject ANY Affiliate Program Application at our sole and absolute discretion. You will have no legal recourse against us for the rejection of your Affiliate Program Application.

You must provide your legal full name, a valid email address, and any other information requested in order to complete the sign up process for an Affiliate account (“account”).

You must be 18 years of age or older to join this Program.

Each account is for use by either a single legal entity (e.g. a company or a partnership) or an individual user. We do not permit you to share your user name and password with any other person nor with multiple users on a network. Responsibility for the security of any user names and passwords issued (including those of any Invitees) rests with you.

Commissions

The commission is 30% of our revenue from customers that you refer. The referral fee will be credited to your Affiliate account once the customer pays their orders.

For the sale of a product to be eligible to earn a referral fee, the customer must click-through a link from your site ( Affiliate Site ), social media, email, or other communications to the Fappeando website and sign up within 30 days of the initial click-through. If they fail to sign up within those 30 days and later return without following your link, you will not earn a referral fee.

We will only pay commissions on links that are automatically tracked and reported by our systems. For our systems to track the referral, the visitor must have cookies enabled. We will not pay referral fees if someone says they signed up through you but it was not tracked by our system.

Payments

Accrued referral fees will be paid once a month. For an Affiliate to receive a commission, the referred account must remain active for a minimum of 31 days.

You cannot refer yourself, and you will not receive a commission on your own accounts.
Payments will only be sent for transactions that have been successfully completed. Transactions that result in chargebacks or refunds will not be paid out.

A summary of sign ups and statement of referral fees is available to the Affiliate by logging into their Affiliate account.
All fees are exclusive of all taxes, charges, levies, assessments

All fees are exclusive of all taxes, charges, levies, assessments and other fees of any kind imposed on your involvement in this Agreement and shall be the responsibility of, and payable by you.
We reserve the right to check and change commissions on the basis of orders actually paid; the notification e-mail is not understood as a confirmed commission – this is only a notification, and every payment will be verified based on real transactions.

Definiciones

Affiliate: The business, individual, or entity applying to or participating in the Affiliate Program, or that displays Fappeando’s products and/or promotions on its website, social media or other means, using an affiliate tracking code in exchange for receiving a comission from Fappeando’s sales resulting directly from such display.

Affiliate Site: The Affiliate’s website which displays Fappeando’s Produts and/or promotions.

Customer: Every customer who buys a product through this program is deemed to be a customer of Fappeando Accordingly, all of our rules, policies, and operating procedures concerning pricing, customer orders, customer service, and products sales will apply to those customers. We may change our policies and operating procedures at any time. Fappeando is not responsible for any representations made by the Affiliate that contradict our rules, policies or operating procedures.

Referral: It is about those visitors who come to your website through other pages or links.

Pricing & Availability

We will determine the prices to be charged for products sold under this Program in accordance with our own pricing policies. T The products prices and availability may vary from time to time. ecause price changes may affect products that you have listed on your site, you should not display products prices on your site. We will use commercially reasonable efforts to present accurate information, but we cannot guarantee the availability or price of any particular product.

Termination

Your affiliate application and status in the Program may be suspended or terminated for any of the following reasons:

• Inappropriate advertisements (false claims, misleading hyperlinks, etc.).
• Spamming (mass email, mass newsgroup posting, etc.).
• Advertising on sites containing or promoting illegal activities.
• Violation of intellectual property rights. Fappeando reserves the right to require license agreements from those who employ trademarks of Fappeando in order to protect our intellectual property rights.
• Offering rebates, coupons, or other form of promised kick-backs from your affiliate commission as an incentive.
• Self referrals, fraudulent transactions, suspected Affiliate fraud.

In addition to the foregoing, Fappeando reserves the right to suspend or terminate your account and refuse any and all current or future use of the Program, or any other Fappeando services, for any reason at any time Such termination will result in the deactivation or deletion of your Affiliate Account, and the forfeiture and relinquishment of all potential or accrued referral fees in your Account if they were earned through fraudulent, illegal, or overly aggressive, questionable sales or marketing methods. Fappeando reserves the right to refuse service to anyone, for any reason, at any time. Upon the termination of this Agreement for any reason, you will immediately cease use of, and remove from your site, all links to the Fappeando website and all our images and other materials provided under the Program.

Affiliate Links

Once you have signed up for the Program you will be provided with an URL link on your affiliate account, in order to identify you when promoting Fappeando in your site, social media, email or other communications. It is your responsibility to ensure each such link is correctly formatted.
We may also provide graphical images that can be used within the links to promote Fappeando. You may use the graphics and text provided by us, or you may create your own as long as they are deemed appropriate according to the conditions and not in violation as outlined in the Termination section. You may also advertise the Fappeando site in online and offline classified ads, magazines, and newspapers.

Relationship of Parties

You and we are independent contractors, and nothing in this Agreement will create any partnership, joint venture, agency, franchise, sales representative, or employment relationship between the parties. You will have no authority to make or accept any offers or representations on our behalf. You will not make any statement, whether on your site or otherwise, that reasonably would contradict anything in this Agreement.

Coupons and Deals

Fappeando occasionally offers coupon to select affiliates and to our newsletter subscribers. If you’re not pre-approved / assigned a coupon, then you’re not allowed to promote the coupon. Below are the terms that apply for any affiliate who is considering the promotion of our products in relation to a deal or coupon:

• Affiliates may not use misleading text on affiliate links, buttons or images to imply that anything besides currently authorized deals to the specific affiliate.
• Affiliates may not bid on Fappeando Coupons, Fappeando Discounts or other words implying coupons or discounts are available when that’s not the case.
• Affiliates may not generate pop-ups, pop-unders, iframes, frames, or any other seen or unseen actions that set affiliate cookies Your link must send the visitor to the merchant site.

Limitations of Liability

Fappeando and any of its directors, employees, shareholders or agents, exclude all liability and responsibility for any amount or kind of loss or damage that may result to you or a third party (including without limitation, any direct, indirect, punitive or consequential loss or damages, or any loss of income, profits, goodwill, data, contracts, use of money, or loss or damages arising from or connected in any way to business interruption, and whether in tort (including without limitation negligence), contract or otherwise) in connection with this Program. Nothing in this legal notice shall exclude or limit Fappeando’s liability for:

(a) death or personal injury caused by negligence;
(b) fraud;
(c) misrepresentation as to a fundamental matter; or
(d) any liability which cannot be excluded or limited under applicable law.

If your use of material provided under this Program results in the need for servicing, repair or correction of equipment, software or data, you assume all costs thereof. Fappeando’s maximum aggregate liability under or in connection with these Terms, or any collateral contract, whether in contract, tort (including negligence) or otherwise (a “Claim”), shall be limited to a sum equal to the aggregate amount which we are obliged to pay you in the twelve (12) month period immediately prior to the period giving rise to such Claim.

Term of the Agreement

The term of this Agreement begins upon your acceptance in the Program and will end when your Affiliate account is terminated.
The terms and conditions of this agreement may be modified by us at any time. If any modification to the terms and conditions of this Agreement are unacceptable to you, your only choice is to terminate your Affiliate account. Your continuing participation in the Program will constitute your acceptance of any change.

Notice

All notices given by you to us must be given to Fappeando at hola@fappeando.com . We may give notice to you at the e-mail address you provided to us when registering. Notice will be deemed received and properly served 24 hours after an e-mail is sent. In proving the service of any notice, it will be sufficient to prove that such e-mail was sent to the specified e-mail address of the addressee.

Electronic Signatures Effective

The Agreement is an electronic contract that sets out the legally binding terms of your participation in the Fappeando affiliate program. You indicate your acceptance of this Agreement and all of the terms and conditions contained or referenced in this Agreement by completing the Fappeando application process. This action creates an electronic signature that has the same legal force and effect as a handwritten signature.
